DISTANCE SALES AGREEMENT

DISTANCE SALES AGREEMENT

This agreement has been drawn up in accordance with the Regulation on the Procedures and Principles for the Implementation of Distance Contracts, published in the Official Gazette dated June 13, 2003, and numbered 25137, which mandates the conclusion of a contract for sales conducted over the internet, and is presented in the following articles.

 

ARTICLE 1 – SUBJECT

This agreement concerns the sale and delivery of the product, the characteristics and sales price of which are specified below, sold by the SELLER to the BUYER, and the scope of the rights and obligations of the parties in accordance with the provisions of Law No. 4077 on the Protection of Consumers - Regulation on the Principles and Procedures for the Implementation of Distance Contracts.

 

ARTICLE 2.1 – SELLER INFORMATION

ARTICLE 2.2 – BUYER INFORMATION

ARTICLE 3 – INFORMATION ABOUT THE PRODUCT SUBJECT TO THE AGREEMENT

The information includes the type, quantity, brand/model, color, number of items, selling price, payment method, and details at the time the order is finalized.

 

ARTICLE 4 – GENERAL PROVISIONS

4.1 – The BUYER declares that they have read and are aware of all preliminary information regarding the essential characteristics, sales price, payment method, and delivery of the product(s) subject to the contract specified in Article 3, and that they have provided the necessary confirmation electronically.

4.2 – The product(s) subject to this contract will be delivered to the BUYER or the person/entity at the address indicated, within the timeframe specified in the preliminary information, depending on the distance of the BUYER's place of residence for each product, provided that this period does not exceed the legal 30-day limit. This period may be extended by a maximum of 10 days, provided that the BUYER is notified in advance.

4.3 – If the product subject to this contract is to be delivered to a person/entity other than the BUYER, THE SPACE TEKSTİL TASARIM VE MAĞAZACILIK LİMİTED ŞİRKETİ cannot be held responsible if the recipient refuses delivery.

4.4 – THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY is responsible for delivering the product in good condition, complete, conforming to the specifications stated in the order, and with any warranty documents and user manuals, if applicable.

4.5 – Payment for the ordered product is conditional upon its delivery being made using the payment method preferred by the BUYER. If, for any reason, the product price is not paid or is cancelled in the bank records, THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY shall be deemed to be relieved of its obligation to deliver the product.

4.6- If, after delivery of the product, the buyer's credit card is used fraudulently or illegally by unauthorized persons due to no fault of the buyer, and the relevant bank or financial institution fails to pay the product price to THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY, the buyer is obligated to return the product to THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY within 3 days, provided that the product has been delivered to the buyer. In this case, the shipping cost shall be borne by the buyer.

4.7- If THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY is unable to deliver the product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or disruptions to transportation, it is obligated to inform the BUYER of the situation. In this case, the BUYER may choose one of the following options: cancellation of the order, replacement of the product with an equivalent if available, and/or postponement of the delivery until the hindering situation is resolved. If the BUYER cancels the order, the amount paid will be refunded in full within 10 days.

 

ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within (14) days from the date of delivery of the product to himself or to the person/entity at the address indicated. To exercise the right of withdrawal, notification must be given to THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY by email or telephone within this period, and the product must not have been used within the framework of the provisions of the relevant article. If this right is exercised, it is mandatory to return the original invoice and a copy of the cargo delivery receipt showing that the product delivered to the third party or the BUYER has been sent to THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY. The product price will be refunded to the BUYER within 10 days following the receipt of these documents. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded. The shipping cost of the product returned due to the right of withdrawal is borne by the BUYER.

Furthermore, consumers cannot exercise their right of withdrawal in cases where the goods are produced according to the consumer's specific requests and demands, or are customized by making changes or additions, or are of a nature that allows for rapid spoilage or exceeding their expiration date.

If the payment is made by credit card or similar payment card, the consumer may request the cancellation of the payment transaction on the grounds that the card was used without their consent and unlawfully. In this case, the card issuer will refund the payment amount to the consumer within 10 days of being notified of the objection.

RETURNS OR CANCELLATIONS OF PRODUCTS PURCHASED DURING CAMPAIGN PERIODS:

Customers must return orders placed during promotional periods in accordance with the promotional rules.


a. When orders are placed during various promotional campaigns such as gift campaigns, buy 3 get 2 free, or discounts on the second item in the cart, the return process will only be completed when all products in that order are returned to the seller. If any products are missing, a refund will not be issued to the buyer until all products have been returned.
b. Even if a product received free of charge (given as a gift by the Seller) during a campaign is returned by the Buyer, the Seller will not issue a refund for these products.
c. If the product(s) ordered by the Buyer within the scope of the campaign are defective, they can be exchanged for an identical product on a one-to-one basis.

Your requests will be processed according to the delivery type you selected at the end of your order. You can pick up the products directly from our Istanbul-based store or request shipment via courier companies. After your orders are confirmed, they will be handed over to the courier company within a maximum of 3 (three) business days.

In the implementation of this agreement, the Consumer Arbitration Boards, up to the value declared by the Ministry of Industry and Trade, and the Consumer Courts located in the place of residence of THE SPACE TEXTILE DESIGN AND RETAIL LIMITED COMPANY shall have jurisdiction.

By completing the order, the BUYER shall be deemed to have accepted all the terms and conditions of this agreement.
